Litigation

Conflict is a fact of modern life. In the course of handling business, real estate, and probate matters, disputes often arise. Most are resolved through negotiation. Where negotiation fails, we are prepared to pursue our clients' interests aggressively. Although many of our cases arise in the local Judicial District, we also litigate in the other Judicial Districts, the Probate Courts, the U.S. District and Bankruptcy Courts, and all relevant courts of appeal. We conduct arbitration proceedings, especially in construction and commercial matters, and mediation, where appropriate.

We have extensive experience in the prosecution or defense of contract and business tort claims, involving such issues as fraud, unfair trade practices, distributorships and franchises, trade secrets, non-competition covenants, disputes among shareholders or partners, intellectual property and unfair competition, antitrust, securities, and civil rights.

Real estate also generates a significant portion of our litigation practice. We pursue actions for partition, foreclosure, specific performance, and eviction. We handle code violation cases, eminent domain, actions to quiet title, and appeals of land use decisions. In the construction area, we become involved in contract disputes, mechanics' liens and bid protests.

We also represent fiduciaries, beneficiaries and other parties in Probate Court litigation, handling will contests, challenges to fiduciary appointments or accountings, and actions to reform trusts, rectify breaches of fiduciary duty, or contest conservatorships.

In employment matters, we represent our clients before state and federal administrative agencies, arbitrators, and state and federal court. We handle discrimination claims under state and federal law, wage and hour issues, wrongful discharge, as well as harassment and retaliation claims.

Our litigation experience extends beyond the trial court level. We have successfully prosecuted or defended appeals in the Connecticut Appellate and Supreme Courts, as well as the Second Circuit Court of Appeals.
